Marketing Practices

All marketing and sales activities must be conducted within the CMS-approved product service area. Marketing practices must give potential enrollees and members accurate information and can not mislead them or misrepresent the benefits and services provided by the organizations. This is one of the reasons producers must be licensed and certified prior to marketing or selling a health plan's prescription drug product.

All materials intended to be distributed to members or potential enrollees, for the purposes of education or enrollment, require health plan and CMS approval. HCSC provides producers with ready-to-use, customizable marketing materials that have already been approved by HCSC's Legal and Compliance departments (as well as CMS) and are available on demand via the secure producer portal.

The use of any materials not approved by HCSC Legal & Compliance and CMS, or the modification of materials approved by HCSC or CMS, will be deemed a violation of the guidelines and subject to disciplinary action, up to and including termination of the producer's contract.

Producers are not permitted to develop their own Web pages for the purposes of marketing Blue MedicareRx.
