Product Promotion

Health plans, and their external partners, can only promote products that pertain to health care and the services offered by the plan sponsor. These should be promoted in such a way that the potential enrollee need not feel:

  • Threatened in any way, with for example:
    • loss of future coverage
    • exorbitant financial penalties
  • Discriminated against for any reason, such as a financial situation, age, or health status
  • Obligated in any way to purchase or renew a policy:
    • No post enrollment incentives allowed
    • No fee may be requested for enrollment

All health plan representatives, including external partners, must always behave in a professional manner. Outbound telephone solicitation and door-to-door selling are strictly prohibited.

All materials used to educate and/or enroll potential enrollees and/or members require HCSC and CMS approval. HCSC provides producers with ready-to-use, customizable marketing materials that have already been approved by HCSC’s Legal and Compliance departments, as well as CMS, and are available on demand via the secure producer portal. These HCSC-approved marketing materials may not be modified or changed in any way by the Producer.
