Health plans, and their external partners, can only promote products that pertain to health care and the services offered by the plan sponsor. These should be promoted in such a way that the potential enrollee need not feel:
- Threatened in any way, with for example:
- loss of future coverage
- exorbitant financial penalties
- Discriminated against for any reason, such as a financial situation, age, or health status
- Obligated in any way to purchase or renew a policy:
- No post enrollment incentives allowed
- No fee may be requested for enrollment
All health plan representatives, including external partners, must always behave in a professional manner. Outbound telephone solicitation and door-to-door selling are strictly prohibited.
All materials used to educate and/or enroll potential enrollees and/or members require HCSC and CMS approval. HCSC provides producers with ready-to-use, customizable marketing materials that have already been approved by HCSC’s Legal and Compliance departments, as well as CMS, and are available on demand via the secure producer portal. These HCSC-approved marketing materials may not be modified or changed in any way by the Producer.
